Divorce Modification
Experienced Mediator and Attorney Assists Clients with Divorce Modifications
No one wishes to relive divorce experience. When you originally finalized your divorce you certainly hoped that you would not have to revisit any aspect of it again.
However, family experiences change. Divorced spouses may move, change jobs, receive greater or lesser income, suffer from illness or disability, or experience other significant changing life developments. Such changes may make it necessary to modify an original agreement regarding child custody, child support, or alimony.
When you have to modify an agreement or court order, it is important to have a trained collaborative family law attorney or mediator who can guide you through the process and help you reach solutions that are right for all parties involved and avoid the expense and headache of litigation.
At the Law Offices of Elizabeth A. Edwards, LLC, we have experience handling all matters associated with modifying agreements or court orders. Through the processes of mediation and collaboration, we help you find solutions that work for you and your family.
Modifying Child Custody, Child Support, or Alimony
Under Connecticut law, a court may modify an agreement based on a substantial change of circumstances experienced by one or more of the parties involved.
Child custody – To change a custody order, a parent must show that the current custody order is no longer in the best interest of the child due to a significant change in circumstances. For example, the change in circumstances may include a change in a parents location, work schedule, physical or mental health, or evidence that the child is experiencing physical, sexual, or emotional abuse.
Child support and alimony – To change a support or alimony order, a party must show a substantial change of circumstances such as a job loss or reduced income on the part of the individual paying support, new employment or increased income on the part of the divorced spouse receiving support, substantial increase in income of the party paying child support or alimony, or significant medical expenses or disability.
